BLACKSWAN CLOTHING reserves the right to modify these Terms & Conditions at any time without prior notice. Changes become effective immediately upon publication on our website.

By purchasing from BLACKSWAN CLOTHING, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.

 

2. Product Availability

All products are subject to availability.

We reserve the right to:

  • Limit quantities purchased.

  • Discontinue products without notice.

  • Refuse or cancel any order at our discretion.

  • Correct pricing or product description errors.

If your order is canceled after payment has been processed, a full refund will be issued.

 

3. Pricing

All prices are listed in U.S. Dollars (USD).

Prices are subject to change without notice.

Applicable taxes and shipping charges will be calculated during checkout.

 

4. Payment

Payment must be received before an order is processed.

We accept approved payment methods offered during checkout.

BLACKSWAN CLOTHING reserves the right to cancel any order suspected of fraud or unauthorized payment activity.

 

5. Shipping

Shipping times are estimates and are not guaranteed.

BLACKSWAN CLOTHING is not responsible for delays caused by:

  • Shipping carriers

  • Weather

  • Holidays

  • Customs

  • Incorrect shipping addresses provided by customers

Customers are responsible for providing an accurate shipping address.

Once an order has shipped, ownership and risk of loss transfer to the customer.

 

6. Refund & Return Policy

Customer satisfaction is important to us.

Eligible Returns

BLACKSWAN CLOTHING accepts returns for unopened, unworn, unwashed clothing within 7 calendar days from the date your order is delivered.

To qualify for a refund:

  • Item must be unopened.

  • Item must be in its original packaging.

  • Tags must remain attached.

  • Item must show no signs of wear, washing, odors, stains, or damage.

  • Proof of purchase is required.

Once the returned item has been inspected and approved, a refund will be issued to the original payment method.

Original shipping charges are non-refundable unless the return is due to our error.

Customers are responsible for return shipping costs unless BLACKSWAN CLOTHING shipped the incorrect or defective item.

 

7. Non-Returnable Items

The following items are final sale and cannot be returned or exchanged:

  • Opened merchandise

  • Worn clothing

  • Washed clothing

  • Sale items

  • Clearance items

  • Limited edition releases

  • Gift cards

  • Accessories (unless defective)

  • Personalized or custom-made items

 

8. Damaged or Incorrect Orders

If your order arrives damaged or you receive the wrong item, you must contact BLACKSWAN CLOTHING within 48 hours of delivery.

Please include:

  • Order number

  • Photos of the item

  • Photos of the packaging

We will review your claim and provide an appropriate resolution.

 

9. Order Cancellations

Orders may only be canceled before they have entered the shipping process.

Once an order has shipped, it cannot be canceled.

 

10. Intellectual Property

All BLACKSWAN CLOTHING logos, artwork, product designs, graphics, slogans, website content, photography, and branding are the exclusive property of BLACKSWAN CLOTHING.

No content may be copied, reproduced, distributed, or used without written permission.

 

11. Limitation of Liability

BLACKSWAN CLOTHING shall not be liable for any indirect, incidental, special, or consequential damages arising from the purchase or use of our products.

Our maximum liability shall never exceed the purchase price of the product.

 

12. Privacy

Customer information is used solely for processing orders, customer service, and marketing communications (where permitted).

We do not sell customer personal information to third parties.

 

13. Fraud Prevention

BLACKSWAN CLOTHING reserves the right to refuse service, cancel orders, or request additional verification if fraudulent activity is suspected.

 

14. Governing Law

These Terms & Conditions shall be governed by and interpreted under the laws of the State of Louisiana, without regard to its conflict of law principles.
